Welcome to the website of S.Athwal Law. By accessing or using athwallaw.ca (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.
1. Informational Purpose Only
Content on this Site is for general information about our firm and criminal defence practice in Ontario. It is not legal advice and does not create a solicitor-client relationship. Laws change and every case is different. Do not act or refrain from acting based solely on website content.
2. No Solicitor-Client Relationship
Sending an enquiry through a form, email, phone, or WhatsApp does not automatically create a solicitor-client relationship. A relationship is formed only when we agree in writing (or as otherwise permitted by professional rules) to act for you, typically through a retainer agreement.
Do not send confidential information until a retainer is confirmed. Unsolicited information may not be privileged.
3. Emergency and Time-Sensitive Matters
If you are detained, under investigation, or facing urgent deadlines, call (289) 501-1851 immediately. Website forms and email may not be monitored every minute.
4. Acceptable Use
You agree not to:
- Use the Site for unlawful purposes
- Attempt to gain unauthorized access to the Site, servers, or related systems
- Interfere with Site security or performance
- Scrape, harvest, or misuse contact details or content without permission
- Submit false, abusive, or harmful content through forms or other channels
5. Intellectual Property
Site content, branding, logos, design, and text are owned by S.Athwal Law or its licensors and protected by applicable intellectual property laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, or exploit Site content for commercial purposes without our prior written consent.
6. Third-Party Services
The Site may include links or embeds (maps, fonts, analytics, messaging). Third-party terms and privacy policies apply to those services. We are not responsible for third-party content or availability.
7. Disclaimer of Warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the fullest extent permitted by Ontario and Canadian law, S.Athwal Law and its lawyers, staff, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or opportunities arising from your use of (or inability to use) the Site. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for professional legal services once a retainer is in place (which is governed by the retainer and professional rules).
9. Privacy
Personal information is handled as described in our Privacy Policy and Cookies Policy.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Courts in Ontario have exclusive jurisdiction over disputes arising from these Terms or your use of the Site, subject to mandatory consumer protections where they apply.
11. Changes
We may update these Terms at any time. The “Last updated” date will change when we do. Continued use of the Site after changes constitutes acceptance of the revised Terms.
